The terms governing your use of the ClearTrace platform and website.

These Terms of Service ("Terms") govern your access to and use of the ClearTrace platform and website provided by AccSource Pty Ltd (ABN 34 629 101 099) ("AccSource", "we", "us"). By accessing the website or using the platform, you agree to these Terms.
ClearTrace is provided to support your firm's AML/CTF compliance workflows. You agree to use the platform only for lawful purposes and in accordance with these Terms and applicable laws, including the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
ClearTrace is a technology platform. It does not provide legal, regulatory, or compliance advice. Your firm remains solely responsible for maintaining a compliant AML/CTF Program and for all compliance decisions. You should obtain independent professional advice where appropriate.
You are responsible for maintaining the confidentiality of account credentials and for all activity under your accounts. You must promptly notify us of any unauthorised use.
Plans are billed annually per firm as set out on our pricing page. Usage based verification fees from third party providers are charged separately at cost based on actual usage. Included quotas reset annually on your billing date.
The platform integrates with third party data and verification providers. Your use of those services may be subject to additional terms, and we are not responsible for the availability or accuracy of third party data.
All intellectual property rights in the ClearTrace platform, website and associated materials remain the property of AccSource or its licensors. You are granted a limited, non exclusive, non transferable right to use the platform during your subscription.
Our handling of personal information is described in our Privacy Policy. You are responsible for ensuring you have a lawful basis to submit any personal information to the platform.
We aim to provide reliable access to the platform but do not warrant uninterrupted availability. Support is provided according to your plan.
To the maximum extent permitted by law, AccSource is not liable for indirect, incidental or consequential loss arising from use of the platform. Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.
Either party may terminate in accordance with the subscription agreement. On termination, your right to access the platform ceases, subject to any data export or retention arrangements agreed.
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non exclusive jurisdiction of its courts.
